By accessing or using the SoCal Pools website (the "Website"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, you must discontinue use of the Website.

Users must be at least 18 years old. Use by anyone under 18 is strictly prohibited.

You agree not to:
- Engage in any unlawful, abusive, harmful, or unauthorized use of the Website.
- Upload malware, attempt to interfere with Website functionality, or circumvent security features.

The Website may describe products or services offered by the Company, including, without limitation, design, construction, renovation, repair, maintenance, and related pool and outdoor-construction services (collectively, the "Services"). All descriptions, estimates, proposals, photographs, testimonials, and service information on the Website are for general informational purposes only and do not constitute binding offers, guarantees, or professional advice. Actual terms, scope of work, specifications, and pricing for any project or Service will be set forth in a separate written agreement signed by you and the Company, which will control in the event of any conflict with the Website.
The Company does not guarantee that any particular design, feature, or product shown on the Website will be available, code-compliant, or suitable for your property. Any timelines, cost ranges, or performance statements are estimates only and are subject to change based on site conditions, permitting, material availability, and other factors.
The Company reserves the right to modify, discontinue, or update any portion of the Website or Services at any time without liability.
5. Intellectual Property
All Website content is owned or licensed by SoCal Pools. Users receive a limited, non-transferable, revocable license to view Website content.
You may not:
- Copy, distribute, or reproduce Website content for any purpose without express written permission.
6. User-Generated Content
You grant the Company a non-exclusive, royalty-free license to use content you submit. You retain ownership, but grant us rights to display, store, and use the content as needed to operate the Website.
You represent and warrant that any content you submit does not violate intellectual property rights or applicable law.

Use of the Website is subject to the Privacy Policy.

We are not responsible for third-party websites and do not endorse them.
9. Disclaimers
THE WEBSITE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.
To the fullest extent permitted by law, the Company disclaims all warranties, express or implied, including any warranties of merchantability, fitness for a particular purpose, title, and non-infringement. The Website content, including any descriptions of Services, project photos, testimonials, pricing, or timelines, is informational only and does not constitute professional, engineering, architectural, or construction advice.
Any examples of prior projects, design concepts, or results are illustrative only and do not constitute a promise or guarantee that similar results will be achieved on your project. Actual results will depend on numerous factors, many of which are outside the Company’s control, including but not limited to site conditions, permitting, inspections, weather, material or equipment availability, and the acts or omissions of third parties.
No information on the Website creates any warranty or modifies any warranty expressly set forth in a written agreement signed by you and the Company. Any warranties regarding completed work, equipment, or materials (if any) will be limited to those expressly set forth in such written agreement and, where applicable, any manufacturer’s written warranty.
10. Limitation of Liability
To the maximum extent permitted by law:
- The Company shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of use, loss of data, business interruption, diminution in property value, or loss of goodwill, arising out of or in connection with the Website, the Services, or these Terms, even if advised of the possibility of such damages.
- Without limiting the foregoing, the Company is not responsible for delays, increased costs, or other impacts arising from permitting or inspection processes, changes in applicable codes or standards, actions or inactions of third-party vendors or subcontractors, material or labor shortages, or weather or other force majeure events.
- In no event shall the Company’s total cumulative liability arising out of or related to the Website, the Services, or these Terms, whether in contract, tort (including negligence), strict liability, or otherwise, exceed the greater of (a) one hundred dollars (US $100) or (b) the total amount paid by you to the Company for the specific Services giving rise to the claim during the three (3) month period immediately preceding the event giving rise to the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless SoCal Pools and its officers, employees, and contractors from any claims arising out of your use of the Website, your violation of these Terms, or your infringement of third-party rights.
12. Dispute Resolution; Binding Arbitration; Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU TO RESOLVE DISPUTES WITH THE COMPANY THROUGH BINDING ARBITRATION ON AN INDIVIDUAL BASIS AND LIMITS THE MANNER IN WHICH YOU CAN SEEK RELIEF.
(a) Informal Resolution. Before initiating any formal dispute resolution process, you agree to first contact the Company at the contact information provided below and attempt in good faith to resolve the dispute informally. If the parties are unable to resolve the dispute within thirty (30) days, either party may pursue the dispute as described below.
(b) Binding Arbitration. Except for (i) small claims actions that qualify for small claims court, or (ii) claims seeking injunctive or equitable relief related to the Company’s intellectual property, any dispute, claim, or controversy arising out of or relating to these Terms, the Website, or the Services (collectively, "Disputes") shall be resolved exclusively by binding, individual arbitration administered by JAMS (or, if JAMS is unavailable, another reputable arbitration provider) under its applicable rules. The arbitration shall be held in Los Angeles County, California, unless the parties mutually agree to a different location or to virtual/remote proceedings.
(c) Class Action Waiver. To the fullest extent permitted by law, you and the Company agree that all Disputes shall be resolved only on an individual basis and not in a class, collective, representative, or private attorney general action. You hereby waive any right to participate as a plaintiff or class member in any purported class, collective, or representative proceeding.
(d) Jury Trial Waiver. To the extent any Dispute is adjudicated in court rather than arbitration, you and the Company knowingly and voluntarily waive any right to a jury trial in any action or proceeding arising out of or related to these Terms, the Website, or the Services.
(e) Enforceability. If any portion of this Section 12 is found unenforceable, that portion shall be severed, and the remainder shall remain in full force and effect, except that the entire Section 12 shall be unenforceable if the Class Action Waiver is deemed invalid or unenforceable.
13. Governing Law
The Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
14. Termination
The Company may suspend or terminate Website access at any time for violation of these Terms or for any lawful reason.
15. Entire Agreement
These Terms constitute the entire agreement governing the use of the Website. If any provision is found invalid, the remainder shall remain in effect.
